Risk update | Stephen Bubb, Risk Manager, LPLC

Stephen Bubb, LPLC Risk Manager, will provide participants with an update on the issues and recurring themes observed by LPLC in the claims against practitioners. His presentation will identify some of the root causes behind these claims and identify some practical tips and strategies you can implement into your day-to-day work to reduce your exposure to claims. You will also have the opportunity to share some of your own thoughts on what works well and what doesn’t in regional practice.

 

VLSB+C Minimum Cyber Expectations - Ethics review | Dr Fabian Horton, Risk Manager, LPLC 

In response to the continued increase of cybercrimes and cyber-breaches, on 7 February 2024 the Victorian Legal Services Board + Commissioner released new Minimum Cyber Expectations (MCEs) for legal practitioners. The MCEs contain system and behavioural controls that law practices should implement in relation to their cybersecurity. In addition, the MCEs define conduct that is capable of constituting unsatisfactory professional conduct or professional misconduct.

In this session, Dr Fabian Horton, LPLC Risk Manager, will review the ethical obligations, how they may be applied, and how a breach of an obligation might be determined. Specifically, Dr. Horton will examine the expected critical controls, system controls, and behavioural controls and the issues that practitioners should consider when implementing and updating their cybersecurity.

 

Navigating Anti-money laundering/Counter-terrorism and new Privacy Act laws | Kirin Mathews, Head of Practice Risk Services, LPLC

This seminar will address the proposed anti-money laundering/counter-terrorism (AML/CT) regulations and changes to the Privacy Act that will affect regional practitioners. The federal government is currently in consultation regarding the application of the AML/CT regime to lawyers, as well as the extension of privacy obligations to small businesses (including the removal of the exemption that applied to businesses with a turnover of $3M or less).

 In this seminar, Kirin Mathews, Head of Practice Risk Services, will provide an overview of:

          - Proposed AML/CT regime application to lawyers
          - AML/CT compliance obligations for your firm
          - Implications of proposed changes to Privacy Act laws for your firm
