The Retail Leases Act [2003] is important legislation regulating leasing contracts in Victoria. Practitioners working in this area of practice should have a good understanding of when the Act does or does not apply.
In this webinar, barristers Samuel Hopper KC and Ben Kelly, will address some of the key provisions and considerations practitioners should take into account when assessing whether the Act applies, and the consequences that may result from that assessment. Additionally, they will highlight some of the risk issues that practitioners should keep front of mind when undertaking leasing work.
Attendees will receive a written paper prior to the webinar, which the presenters will reference and discuss during their presentation. Time will be allocated for questions at the end of the session.

Speaker bios:
Sam Hopper is one of the Victorian Bar’s leading commercial property barristers and is recognised as pre-eminent counsel in retail and commercial leasing disputes, valuation and rental determinations and general property disputes. Sam appears for and advises both private and government clients and appears extensively in VCAT and the superior courts. He is a long-standing and active member of the Law Institute of Victoria’s Leases Committee and maintains a website and blog at www.samhopperbarrister.com.
Ben Kelly practices in all areas of commercial and public law. Ben was a solicitor for 7 years at Clayton Utz, practicing in commercial litigation and public law, and then at Northern Land Council, where he acted in native title litigation in the Federal Court of Australia, negotiating mining agreements and commercial leases. He also lectures in the Corporations Law and Torts subjects at the University of Melbourne.
